重庆居民涉港、澳、台、华侨及外国人离婚登记办事指南

一、离婚登记

I.DivorceRegistration

重庆居民与外国人、华侨、港澳台居民在中国内地自愿离婚的，双方应当共同到本婚姻登记机关办理，并提交以下证件和证明材料：

IfbothaChongqingpermanentresidentandaforeigner,anoverseasChinese,orapermanentresidentofHongKong,MacaoandTaiwandecidetodivorceinChinamainland,theyshallcondctthedivorceregistrationinpersonatthismarriageregistrationathorityatthesametimeandprovidethecredentialsandcertificationdocmentsasfollows:

内地居民：

Mainlandresident:

(一)本人的常住户口簿、身份证

(I)HoseholdRegisterandIDCard

(二)本人的结婚证。(其结婚登记必须在中国内地办理的;属于合法有效的结婚证件。)

(II)MarriageCertificateoftheparty(ThemarriagemstberegisteredinChinamainlandandthemarriagecertificateislegalandvalid.)

(三)双方当事人共同签署的离婚协议书一式三份。(离婚协议书应当载明双方当事人自愿离婚的意思表示以及对子女抚养、财产及债务处理等事项协商一致的意见).

(III)DivorceAgreementsignedbybothpartiesintriplicate(TheDivorceAgreementshallbeindicatedthatbothpartiesdecidetodivorceoftheirownfreewillandbothhavereachedagreementonmattersschaschildcstody,propertyanddebts,etc.)

办理离婚登记的香港居民、澳门居民、台湾居民、华侨、外国人除应当出具前款第(二)项、第(三)项规定的证件、证明材料外，港、澳、台还应当出具本人的有效通行证、身份证，华侨、外国人还应当出具本人的有效护照。

ThepermanentresidentsofHongKong,MacaoandTaiwan,overseasChineseandforeignerswhocondctdivorceregistrationshallpresentthecredentialsandcertificationdocmentsstiplatedintheaforesaidArticle(II)andArticle(III),inaddition,thepermanentresidentsofHongKong,MacaoandTaiwanshallalsopresenttheirvalidpermitsandIDCards,andtheoverseasChineseandforeignersshallpresentlytheirvalidpassportsadditionally.

二、办理时限及程序

婚姻登记机关对当事人提交的证件、证明材料审查并询问相关情况。对符合条件的，当场予以登记，发给婚姻证件;对当事人不符合离婚条件不予登记，向当事人说明理由。其程序如下：

Themarriageregistrationathoritychecksthecredentialsandcertificationdocmentsprovidedbypartiesconcernedandinqiresrelevantinformation.Themanandwomanwhomeetthereqirementsshallbepermittedtomakeregistrationimmediatelyandissedwithrelevantcertificates;thosewhodonotmeetthereqirementsofdivorceshallnotbepermittedtomakeregistrationandreasonssholdbeexplained.Theprocedresareasfollows:
